Mountaintop Condos (“we”, “our”, or “us”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have implemented the following policy concerning copyright infringement.

If you believe that any content on mountaintopcondos.com infringes upon your copyright, please notify our Designated Copyright Agent using the procedure outlined below.

1. Filing a DMCA Notice (Takedown Request)

If you are a copyright owner or an agent thereof, and you believe that any content on our Site infringes your copyright, you may submit a DMCA takedown request by providing the following information in writing to our Designated Copyright Agent:

  • A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.
  • Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the infringing material and information reasonably sufficient to permit us to locate the material on the Site (such as a URL or specific page).
  • Your contact information, including your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Upon receipt of a valid DMCA notice, we will promptly investigate the claim and remove or disable access to the infringing material as required by the DMCA. We may also notify the alleged infringer of the takedown request.

2. Filing a Counter-Notice

If you believe that the material that was removed or disabled as a result of a DMCA notice does not infringe any copyright, or if you have the legal right to post the material, you may file a counter-notice. To be effective, a counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or disabled, and the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in [Insert Your Jurisdiction], and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Please send the counter-notice to our Designated Copyright Agent listed above.

Upon receiving a valid counter-notice, we will forward it to the party who submitted the original DMCA claim. If the original claimant does not file a lawsuit within 10-14 business days, we may restore the removed content or cease disabling access to it.

3. Repeat Infringers

We reserve the right to terminate or block access to the Site for any user who is a repeat infringer. A repeat infringer is a user who has been the subject of multiple DMCA notifications or other allegations of copyright infringement.

4. Misrepresentation

Please note that any person who knowingly makes a material misrepresentation in a DMCA notice or counter-notice may be liable for damages (including costs and attorneys’ fees). Therefore, if you are unsure whether the material in question infringes your copyright, we recommend seeking legal advice.
